Waiver and Release of Liability Agreement

This Waiver and Release of Liability Agreement (the "Agreement") is entered into on the date you booked your tour and between you and Tour Brasov. 

 

Services. Tour Brasov operates a website that offers tours in Brasov, Romania. As part of the Services, the Tour Brasov partners tourists from other countries with local Tour Guides in Brasov, Romania.

 

Waiver and Release of Liability. The Tourist, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby waive, release and discharge Tour Brasov, its affiliates, and its respective directors, officers, employees, agents, and assigns from any and all claims, damages, losses, liabilities, and expenses, including reasonable attorneys' fees, arising out of or in connection with any incident or occurrence that results in injury or harm to the Tourist during a tour arranged through Tourbrasov.com

 

Assumption of Risk. The Tourist acknowledges and assumes the inherent risks associated with the tour, including but not limited to the risk of physical or emotional harm, and agrees to take full responsibility for any and all injuries or harm that may occur during the tour.

 

Compliance with Law. The Tourist shall comply with all applicable laws and regulations in Romania in connection with the tour. Tour Brasov shall not be responsible for any failure by the Tourist to comply with such laws and regulations.

 

Term and Termination. This Agreement shall be effective as of the date of execution and shall remain in effect for the duration of the tour arranged through the tourbrasov.com

 

Governing Law. This Agreement shall be governed by and construed in accordance with the laws of Romania without giving effect to any choice of law or conflict of law provisions.

 

Entire Agreement. This Agreement constitutes the entire agreement between the parties with respect to the subject matter hereof and supersedes all prior agreements and understandings, whether oral or written.

 

Severability. If any provision of this Agreement is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced.

 

Electronic Signature. The Tourist agrees that by signing this Agreement electronically, they are signing it voluntarily and with the intent to be bound by its terms and conditions.

 

IN WITNESS WHEREOF, the parties have executed this Agreement as of the date first above written.
